Sorry, Airport Authority - you lost!

On the 26th of this month, Judge Stephen Scarlett DISMISSED the St. Marys Airport Authority's lawsuit against the city of St. Marys, ruling that the city has not impeded the operation of the airport; the Airport Authority can not compel the city to renew their lease on the airport in May of '09 when it expires; and the city has every right to be the sole entity to decide whether or not the airport gets moved. I've read the order. It was e-mailed to me as an attached PDF. I just can't seem to figure out how to get stuff that comes to me as a PDF to publish on this blog. Anyone know how?

Jay you SCOOPED the Tribune & Georgian. The don't have the ruling listed in their current issue. Good reporting!

I have read the order also. What happened is the Judge dodged the bullet and did not advise what could or could not be done. He hedged on stating it was "political." The question before the court was not about moving the airport. The court was asked to determine what role the Authority plays in decisions about the airport. As it stands now there is no decision on who can do what. Also, there is the issue that the only action by the City was to pursue the issue of moving the airport "if it was at no costs to the City." It is a stale mate and the matter will linger on. It will be a cost to the City if it was to be moved. Not one person with the City has denied that. So it is nothing gained, at this point. No meaningful business as usual. If the City were to work with the Authority in addressing the issue that would be progress. But that will not happen. Also, the City is busted, broke, over extended and has no solution for that. Let alone the airport issue.

Not necessarily so. If enough councilmen can muster up the courage to defy the DMA and the Airport Authority hobbyists and do what is best for the other 99+% of tgheir constituents, they will vote to not renew the AA's lease on the airport when it expires in May. yep, you're right. I just listened to it. The T&G characterizes the judges ruling as saying the the Airport Authority is "irrelevant."

I like the part about the T&G having received an "anonymous tip"
abou the existnece of the ruling after their deadline yesterday. Let's see: what time did I post that story yesterday? :-)
